Part 3950 Medicaid Code of Administrative Rules, Section #0392, "Post-Eligibility Treatment of Income"
Type of Filing Amendment
Regulation Status Inactive
Effective 07/01/2015 to 09/10/2015

Regulation Authority:

Chapters 40-6 and 40-8 of the Rhode Island General Laws, as amended; Title XIX of the Social Security Act

Purpose and Reason:

The Executive Office of Health & Human Services (EOHHS) is filing this “emergency” amendment to rule #0392 “Post-Eligibility Treatment of Income” in order to incorporate recent changes to the federal 2015 Medicaid “Spousal Impoverishment Standards”, the updated minimum monthly maintenance needs allowance (MMMNA), and the monthly housing allowances for community spouses that become effective July 1, 2015. Sections being amended include: 0392.15.20.05; 0392.15.20.10; and 0392.15.25.

Brief statement of Reason for Finding Imminent Peril:

Because the revised standards were published by the federal Centers for Medicare and Medicaid Services (CMS) on May 4, 2015 and must take effect on July 1, 2015, EOHHS is filing as an “emergency.”
